Planning and Zoning
o R-1 Zoning, no design overlays
o Finish Grade/ Building height requirements (33.930.50, Measuring Height, Base part 2)
- Finish Grade is lowest point on property
- Planning and zoning will require the mid-point of gables and below to be within building height requirements
- Height adjustments are required for the following:
o 25’ height limit of structure within first 10’ front property line
o Max. building height is 45’ (starting 10’ above lowest point on site due to garage level being built into grade)
- Building setback adjustments are required at the front property line from 3’ to 0’ and on the North side property line from adjustments down to 0’ at the Bay Window and 2’-6” for the rest of the façade
- The above adjustments are Type II adjustments
- PDOT is required to approve any construction in the Public Right of Way
- Show cross sections through site for adjustements

o Typically requires 11’ of Public space (4’-6” curb and median, 6’ sidewalk, 6” to property line)
o “Half Street Improvement” required (Curb and gutter line must be rebuilt)
o Footings, doors, site access, planters etc. cannot be in City/ Public Right of Way
o “Inquiry Follow up” is required with Tom Biornstad for site/ building access on Public Right of Way
o Application for “Revokeable permit” is required for construction within Public Right of Way
o Bio filters are not permitted in Public Right of Way
o 2% slope on sidewalk perpendicular to street

o Impervious area x .07 = required area surface vegetaded facility for storm water
(4860 sq. ft. x .07 = 340 sq. ft. of Flow Through Planter area
o Planter area is permitted up to property line
o Sanitary and storm water lines may “Y” at curb
Life Safety
o Two primary occupancies: S-2 for Garage
R-2 for condominiums
o First floor public areas must be fully accessible, residential units must be adaptable per 1106.1.10.2
o Construction type will impact hourly ratings and sprinkler requirement (construction type III-B must be sprinklered to meet building height requirement and 5 residential stories
o First floor public area is considered “A” Occupancy and must have an occupancy level of less than 49 occupants and no travel distance greater than 75’ to have one exit (current plan meets these requirements)
o First floor public area is required to have (2) toilet rooms, 1 men’s, 1 women’s (see chapter 29)
o Elevator must be 84” deep
o 2 hour rated shafts
o “Area of Rescue”, Section 1107, are required. Current stair plans meets the requirements, the Area of Rescue on the Sixth floor must be located on the roof terrace, adjacent to the stair
