ORDINANCE No. 182913

 

 Authorize Intergovernmental Agreement with Clean Water Services District to control garlic mustard and knotweed in the Tualatin River Basin up to $24,000 for 2008/09 and 2009/10 (Ordinance)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The Portland City Council adopted the Clean River Program on April 6, 1990, which included planting native vegetation along streams and to partnering with other jurisdictions. On May 10, 1995, the Council reaffirmed the goals of the Clean River Program and set actions for BES.

2.  On November 30, 2005, the Council passed a resolution to create a strategy for the management of invasive plants. Garlic mustard roots exude a chemical that is toxic to other plants, including trees. Knotweed grows in dense clumps and displaces native vegetation needed for fish and wildlife.

3.  On March 8, 2006, the Council adopted the 2005 Portland Watershed Management Plan, which includes actions such as planting native vegetation and removing non-native invasive species.

4.  The District is a public utility which protects water resources in the Tualatin River and, along with the City, is a member of the Tualatin Basin Designated Management Agencies. In 2008, the Council authorized a cooperative partnership to control garlic in the Tualatin River Basin.

5.  The Bureau of Environmental Services and the District have agreed to provide eradication of garlic mustard and knotweed through the attached FY08-09 and FY 09-10 Intergovernmental Agreement. The established cost is $24,000 total. Funds are available cost center ESWS000009.

 

NOW, THEREFORE, the council directs:

 

 a.  The Commissioner of Public Affairs and Auditor are authorized to execute a contract with the District for the purpose described in Section 1, in the amount of $9,000 (FY 08-09) and $15,000 (FY 09-10) total not to exceed $24,000.

 

 b.  The Bureau of Environmental Services Director is authorized to execute future amendments to this agreement to extend the terms or increase the agreement amount, not to exceed 25% of the approved contract amount.

 

c.  The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.
