ORDINANCE No. 182760
Remove redundant and outdated language, fix organizational and grammatical errors, reconcile conflicting Code provisions, increase program efficiency and effectiveness, and improve public comprehension to the Public Improvements Code. (Ordinance; amend Title 17)
The City of Portland ordains:
Section 1. The Council finds:
1. Title 17 of the Portland City Code authorizes public improvements to the City’s streets, pedestrian facilities, sanitary sewer systems, and stormwater management systems; and regulates improvement activities in public rights-of-way.
2. The proposed Code changes represent more than two years of cooperative effort by the Bureau of Environmental Services, Bureau of Transportation, Planning Bureau, City Attorney’s Office and other interested City agencies to carefully address legal and programmatic issues raised by out-dated, contradictory, confusing and redundant Code language.
3. The Development Review Advisory Committee examined the proposed Code changes to ensure that amendments were limited to housekeeping issues, and to identify policy issues for future consideration by the Committee, City staff and City Council. City staff will incorporate more substantive changes into future updates to Title 17.
NOW, THEREFORE, the council directs:
a. Amend Chapters 17.04, 17.08, 17.12, 17.19, 17.23, 17.25, 17.26, 17.28, 17.35, 17.41, 17.44, 17.45, 17.48, 17.52, 17.68, 17.82, 17.84, 17.88, and 17.96 of the City Code as set forth in Exhibit A of this Ordinance.
b. Amend Figure 2 of Section 17.24.020 as set forth in Exhibit B of this Ordinance.
c. Repeal Chapters 17.27 and 17.76 in their entirety.
