ORDINANCE No. 182529

*Revise ordinance to add the delegation of authority to sign the contract for Phase I of N Russell St Improvements Project (Ordinance; amend Ordinance No. 182367)

The City of Portland ordains:        

Section 1.  The Council finds:

1.  On November 26, 2008, Council passed Ordinance No. 182367 authorizing a contract for Phase I of the construction of N Russell St Improvements Project from N Intestate Ave to N Kerby Avenue.

2. The Ordinance did not specify the delegation of authority for anyone to sign the contract.

3.  The directive for signature authority was incomplete and directive needs to be amended to read, "The Purchasing Agent is authorized to negotiate and execute a contract, provided the contract has been approved as to form by the City Attorney's office."

NOW, THEREFORE, the Council directs:

a.  Ordinance No. 182367 be amended to amend directive a. to read, "a. The Purchasing Agent is authorized to negotiate and execute a contract, provided the contract has been approved as to form by the City Attorney's office.

Section 2. The Council declares that an emergency exists because the Project went to bid and we have a low bidder; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
