ORDINANCE No. 182514

 * Authorize contracts and provide for payment for construction of the Portsmouth Force Main Project, Segments 1 and 2 Project Nos. 9075 and 9039 (Ordinance)

The City of Portland ordains:

Section 1.  The Council finds:

1.  The Bureau of Environmental Services has designed the Portsmouth Force Main Project to comply with an Amended Stipulation and Final Order (ASFO) with the Oregon Department of Environmental Quality to reduce combined sewer overflow discharges to the Willamette River by December 1, 2011.

2.  For purposes of construction, the Portsmouth Force Main Project has been divided into two bid packages: Segment 1 Swan Island and Segment 2 Willamette Blvd.

3.  Bid documents have been prepared for Portsmouth Force Main Segments 1 and 2 and the project is ready for construction.

 4.  The established cost is $33,220,916 for Segment 1 and $30,007,000 for Segment 2 (optimal level of confidence). Funds are available in the Sewer System Operating Fund, FY 2008-2009 Budget, Bureau of Environmental Services, Project Numbers 9075 and 9039, (WBS #EO9075.C60 and #EO9039.C60, CC#ESEN911010).

NOW, THEREFORE, the council directs:

 a.  The Commissioner of Public Affairs and Auditor are authorized to execute contracts with lowest responsible bidders for the purpose described in Section 1.

 b.  The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.

Section 2.  The Council declares that an emergency exists because delay will result in a delay in construction and impact the overall completion of the mandated CSO Program deadline. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
