ORDINANCE No. 182503

*Amend contract with Hahn and Associates, Inc. for additional work and compensation for the Brownfield Investment Fund being used on the SE Ankeny Brownfield project. (Ordinance, Amend Contract No. 36788)

The City of Portland ordains:

Section 1.  The Council finds:

1.  The Bureau of Environmental Services (BES) has need of continuing professional environmental services provided by Hahn and Associates for the completion of the City of Portland SE Ankeny Brownfield project supported by the Brownfield Investment Fund project.

2.  Hahn and Associates is providing professional environmental engineering and geological services under Contract No. C36788

3.  Through the management and oversight of environmental remediation at the SE Ankeny brownfield site enrolled in the City of Portland Brownfield Investment Fund, previously unidentified contamination was found requiring additional soil removal beyond the original project scope.

4.  The additional costs exceed the established cost limit of Contract No. 36788 with Hahn and Associates in the amount of $500,000.

5.  The established cost of this contract amendment is $500,000. Funds are available in the Brownfield Investment Fund, FY 08-09 Budget, Bureau of Environmental Services, Cost Center ESPP000013. The Brownfield Investment Fund is a loan program and all expenses under this program will be reimbursed to the City.

NOW, THEREFORE, the council directs:

 a.  The Commissioner of Public Affairs and Auditor are authorized to execute Amendment 1 to contract #C36788 with Hahn and Associates for the purpose described in Section 1, in the amount of $500,000.

 b.  The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Brownfield Investment Fund Budget when demand is presented and approved by the proper authority.

Section 2.  The Council declares that an emergency exists because services being provided are exceeding the initial contract amount. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
