ORDINANCE No. 182460
*Authorize an Intergovernmental Agreement with the Tri-County Metropolitan Transportation District for enhanced security and cleaning of the 5th and 6th Avenue transit mall and the interim transit mall on 4th and 3rd Avenues during construction of light rail facilities on 5th and 6th Avenues through June 30, 2009 (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. As part of the Regional Transportation Plan (RTP) the City and Tri-County Metropolitan Transportation District (TRIMET) have cooperated in the construction of light rail facilities on 5th and 6th Avenues extending from NW Glisan Street to SW Jackson Street, this is known as the “Portland Transit Mall”.
2. Construction on the Portland Transit Mall began in January of 2007 and bus service will return in May of 2009.
3. During the period the Portland Transit Mall is under construction bus service will be relocated to 4th and 3rd avenues, the “interim transit mall”.
4. The City and TRIMET entered into an agreement in 2007 to provide enhanced security and cleaning efforts on the Transit Mall and temporary Transit Mall through December 2008.
5. It is in the interest of the City and TRIMET to ensure that the enhanced security and cleaning effort on the both the transit mall and the interim transit mall is continued until June 30, 2009.
6. TRIMET will provide enhanced cleaning services on the transit mall and the interim transit mall.
7. TRIMET will provide enhanced security services on the transit mall.
8. TRIMET and the Portland Bureau of Transportation desire to enter into an intergovernmental agreement that identifies the services to be provided and establishes a cost sharing arrangement for these services.
9. The City’s contribution to the enhanced services for the first half of calendar year 2009 is $250,000.00
10. The Portland Bureau of Transportation has funding in its parking meter fund available to contribute the City’s share.
NOW, THEREFORE, the Council directs:
a. The Mayor and City Auditor are authorized to enter into an intergovernmental agreement with the Tri-County Metropolitan Transportation District (TRIMET) in a form substantially in accordance with the agreement attached as Exhibit A.
b. The Mayor and Auditor are hereby authorized to draw and deliver checks to the Tri-County Metropolitan Transportation District (TRIMET) chargeable to the Portland Bureau of Transportation parking meter fund.
Section 2. The Council declares that an emergency exists because it is critical that the City enter into an intergovernmental agreement while construction continues and bus operations begin on the Portland Transit Mall; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
