Ordinance No. 182445 AS AMENDED

* Authorize an Intergovernmental Agreement with Portland Public Schools and the Tri-County Metropolitan Transportation District of Oregon to expand a pilot program to offer fareless public transportation for students at three Portland high schools, with the intention to measure results and expand the program as appropriate (Ordinance)

The City of Portland ordains:

Section 1. The Council finds:

1.  On June 11, 2008, Council unanimously approved Resolution #36611 expressing support for a proposal by the Multnomah Youth Commission to create a “Youth Pass Program” allowing fareless access to public transportation for students.

2.  On September 3, 2008, Council unanimously approved Ordinance #182165 directing the Mayor and the Commissioner of Public Utilities to enter into a contract with TriMet and Portland Public Schools for a pilot project to offer free transit passes to students at two Portland high schools.

3.  The City, TriMet and Portland Public Schools now wish to enter into a new formal agreement regarding the roles and responsibilities of each party for the expansion of the pilot project

NOW, THEREFORE, THE COUNCIL DIRECTS

a.  The Mayor and the Commissioner of Public Utilities are hereby authorized to enter into a contract with TriMet and Portland Public Schools in a form substantially in accordance with the intergovernmental agreement attached as Exhibit A.

b.  The Mayor and City Auditor are hereby authorized to pay for said agreement from general funds.

Section 2. The Council declares that an emergency exists because students are to receive passes effective on the first day after winter break, January 5, 2009; therefore this ordinance shall be in full force and effect from and after its passage by Council.
