ORDINANCE No. 182444

Authorize Lease of City property on SW Sam Jackson Park Road to WSCO Petroleum Corporation.

The City of Portland ordains:

Section 1. The Council finds:

1.  The City owns approximately 11,325 square feet of land at the intersection of SW Sam Jackson Park Road and SW Terwilliger Blvd, which is assigned to Portland Parks and Recreation (PP&R).

2.  This parcel is adjacent to land that is owned by WSCO Petroleum and used as a service station. In order to effectively access the service station, WSCO Petroleum needs access over the PP&R property.

3.  Pursuant to Ordinance No 173366 and Contract No. 51166, the City has been leasing this parcel to WSCO Petroleum or its predecessors since 1999. The lease has expired and the parties wish to enter into a new lease agreement.

4.  The new agreement has a term of five (5) years with a five year renewal option, and the rent has been increased to $1200 per month, with further adjustments thereafter.

NOW, THEREFORE, the Council directs:

 a.  The Commissioner in Charge of the Parks and Recreation Bureau is authorized to execute a lease agreement with WSCO Petroleum for PP&R property located on SW Sam Jackson Park Road. Such lease agreement shall be in a form substantially like the form of agreement attached hereto, as approved as to form by the City Attorney.
