ORDINANCE No. 182440

*Authorize bid and award contract for construction of the North Leadbetter Overcrossing Project. (Ordinance)

Section 1.  The Council finds:

1.  The Portland Office of Transportation (PDOT) and the Port of Portland have a long history of working together to complete improvements to the public right of way that benefit the Port of Portland, its customers and the traveling public.

2.  In December 2006, PDOT and the Port of Portland entered into an agreement to complete five transportation projects, one of the projects is the North Leadbetter Overcrossing project. (Contract No. 58517)

3.  In April 2007, the City of Portland entered into an agreement with the Oregon Department of Transportation to provide funding for the North Leadbetter Overcrossing project. (Contract No. 52833)

4.  The Contract Drawings and Specifications are completed and the project is awaiting final approval from the Federal Highway Administration.

5.  The budget for this action is included in Adopted Budget for FY 2005-06 for the City of Portland Office of Transportation.

6.  The Bureau’s level of confidence in the cost estimates for this project is moderate, the project design is completed; however, the current bidding climate is volatile.

NOW, THEREFORE, the Council directs:

a.  That a contract be authorized with the most favorable bidder as designated by the Council.

b.  The Mayor and the Auditor are hereby authorized to draw and deliver warrants chargeable to the Transportation Operating Fund, Fund 200000, Business Area TR00,

 when demand is presented and approved by the proper authorities.

Section 2. The Council directs that an emergency exists because the project is ready to go to bid; therefore, this Ordinance shall be in full force and effect from and after its passage by Council.
