ORDINANCE No. 181733

 

 

*Authorize an Intergovernmental Agreement with the Port of Portland to acquire certain right of way for improvement at NE Airport Way and NE Holman St (Ordinance)

 

 

The City of Portland ordains:        

 

Section 1.  The Council finds:

 

1.  The Portland Office of Transportation and the Port of Portland have a long history of working together on infrastructure projects.

 

2.  The Port of Portland and the Cascade Station Development Corporation entered into an agreement to construct several intersection improvements on city streets necessary to mitigate the impacts of the Cascade Station Development.

 

3.  The intersection improvement at NE Airport Way and NE Holman St. requires additional public right of way.

 

4.  The agreement will reimburse the City of Portland for all costs related to acquisition of the right of way.

 

 

NOW, THEREFORE, the Council directs:

 

a.  That the Commissioner-in-Charge and the Auditor are authorized to enter into an Intergovernmental agreement between the City of Portland and Port of Portland for certain right of way services, similar in form to the agreement attached to this ordinance, and by this reference made a part hereof.

 

Section 2. The Council declares that an emergency exists because acquisition of the right of way is necessary to meet contractual obligations of the Port of Portland and Cascade Development Corporation; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
