ORDINANCE No. 181585

 

*Authorize an Initiative Partnership Agreement with the Oregon High Intensity Drug Trafficking Area Executive Board, Oregon Department of Justice and U.S. Marshals Services as lead agency for the Oregon HIDTA Fugitive Task Force to secure participating federal, state and local law enforcement agencies mutual assistance for enforcement of federal and state drug laws (Ordinance)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.  The Oregon High Intensity Drug Trafficking Area (HIDTA) Program, administered by the Office of National Drug Control Policy, has granted funding to the Portland Police Bureau for operational expenses of the Portland HIDTA Initiative.

 

2.  In connection with the HIDTA Initiative, the City of Portland Police Bureau has been awarded funding for efforts as “disrupting and dismantling drug trafficking organizations in Multnomah, Washington, and Clackamas Counties by employing a multi-agency approach to significantly impacting drug availability in the area.”

 

3.  The multi-agency Portland HIDTA Initiative is jointly managed and supervised by the Portland Police Bureau Drugs and Vice Division in conjunction with the U.S. Drug Enforcement Administration (DEA).

 

4.  The proposed agreement, attached as Exhibit A, will memorialize the agreement regarding operational and program requirements and partnership expectations between Oregon HIDTA Fugitive Task Force members and the Oregon HIDTA Executive Board.

 

5.  The proposed agreement will secure to the participating federal, state, and local law enforcement agencies the benefits of mutual assistance in addressing common problems that spring from drug trafficking.

 

6.  The City is authorized to enter into the agreement by the provisions of ORS 190.003 to 190.110.

 

7.  The proposed agreement prohibits Portland officers from taking action prohibited by Oregon statute, the Oregon Constitution or Oregon decisional law, and specifically requires that officers working with HIDTA partners continue to comply with ORS 181.575 and ORS 181.850.

 

8.  Participation in HIDTA does not require matching funds.

 

 

 

 

NOW, THEREFORE, the Council directs:

 

a.  The Chief of Police, or her designee, is authorized to enter into the Oregon HIDTA Initiative Partnership Agreement, in a form substantially in accordance with the agreement attached as Exhibit A.

Section 2. The Council declares that an emergency exists because delay in proceeding with this agreement will unnecessarily impede potential benefits to the City of Portland; therefore this ordinance shall be in force and effect from and after its passage by the Council.
