ORDINANCE No. 181525
Authorize an Intergovernmental Agreement with Metro to receive professional, technical, construction, and easement services for Sellwood Sewer Interceptor Capital Improvement Project No. 6973 (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The Bureau of Environmental Services (BES) in partnership with Metro Regional Government is implementing sewer system improvements that eliminate sewer overflows along the Sellwood Interceptor.
2. BES and Metro, under their respective charter authorities, are authorized to enter into cooperative agreements for the design and construction of public utility improvements and community benefits.
3. BES desires to establish a permanent combined sewer easement on Metro-owned property.
4. BES desires to relocate an existing railroad located on Metro-owned property.
5. BES desires to construct a utility maintenance road along Metro-owned property
6. BES desires to use the professional and technical services of Metro to efficiently record said sewer easement, procure track realignment services, and manage railroad construction work.
7. The established cost is $250,000. Funds are available in the Sewer System Operating Fund, FY 2007-08 Budget, Bureau of Environmental Services, Center Code 145-22-110, Project No. 6973, Account No. 567000.
NOW, THEREFORE, the council directs:
a. The Director of the Bureau of Environmental Services and City Auditor are authorized to execute an Intergovernmental Agreement in a form substantially in accordance with the agreement attached as INTERGOVERNMENTAL AGREEMENT and EXHIBITS A and B, with Metro for the purpose described in Section 1, in the amount of $ 250,000.
b. The Director of the Bureau of Environmental Services is authorized to execute amendments to this agreement to extend the term and/or increase the agreement amount.
c. The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.
