*Pay claim of Gabe Kreofsky (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. Gabe Kreofsky has filed a claim against the City for property damages suffered in an accident involving Parks Bureau on March 19, 2007.
2. The claim has been investigated by Risk Management Services. Investigation indicates there is risk the City may be found liable. Therefore, in order to avoid the risk of a large jury award, we feel it is prudent to compromise the claim at this time.
3. Risk Management Services recommends the property damage claim be compromised for $5666.14, subject to the claimant providing the City with a release in a form to be approved by the City Attorney. Risk Management has previously advanced $4892.50 to Gabe Kreofsky, McCollum Automotive, and Insurance Appraisal Services for payment of various components of Gabe Kreofsky’s property damage claim. These payments have been made within the limits of Risk Management’s authority. Payment of the remaining rental car payment will exceed the limit of Risk Management’s authority, and requires Council approval.
NOW, THEREFORE, the Council directs:
a. The Mayor and the Auditor are hereby authorized to draw and deliver a check in the amount of $773.64 made payable to Enterprise Rent A Car. Total property damage claim settlement is $5666.14.
b. Risk Management Services will execute a payment authorization in the amount set forth in sub-paragraph (a) above.
Section 2. The Council declares that an emergency exists in order to avoid undue and costly delay in settling this claim; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
