ORDINANCE NO. 181531
* Authorize subrecipient contract with Portland Development Commission in the amount of $12,938,142 for rental housing development and provide for payment. (Ordinance)
The City of Portland ordains:
SECTION 1. The Council finds that:
1. The City of Portland’s Bureau of Housing and Community Development (BHCD) has acquired funds from the Federal Department of Housing and Urban Development (HUD) for use as authorized under HUD regulations for the Community Development Block Grant (CDBG) Program. The City has entered or is about to enter into a contract with PDC to conduct a CDBG Program for certain areas pursuant to Title I of the Housing and Community Development Act of 1974 as amended.
2. The Portland HOME Consortium is the recipient of funding under the HUD HOME Investment Partnership Program (authorized by Public Law 101-625, Title II, November 26, 1990) for the development of affordable housing for low income households.
3. PDC is capable and willing to implement a portion of the FY 2007-08 CDBG program as adopted in the City’s 2007-08 Consolidated Plan, for the City in the amount of $3,605,663.
4. PDC is capable and willing to implement a portion of the FY 2007-08 HOME program as adopted in the City’s 2007-08 Consolidated Plan, related to affordable housing development in the amount of $6,806,952.
5. PDC is capable and willing to implement a portion of the FY 2007-08 Housing Opportunites for People with AIDS program as adopted in the City’s 2007-08 Consolidated Plan, for the City in the amount of $279,557.
6. The City Council also approved $1,200,000 of General Fund and $1,045,970 of Housing Investment Fund to support the development of affordable housing for low income households.
7. City Council now desires to enter into a formal agreement with PDC in the amount not to exceed $12,938,142 to undertake various activities for rental housing development, permanent supportive housing, asset management and administration of theCity’s Economic Development Initiative/108 program.
NOW, THEREFORE, the Council directs:
a. The Commissioner of Public Works and Auditor are hereby authorized to enter into a contract with Subrecipient for the provision of rental housing development in a form substantially in accordance with the agreement attached as Exhibit A (attached to original ordinance only).
b. The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the FY 2007/08 budget when demand is presented and approved by the proper authority.
Section 2. The Council declares that an emergency exists because delay in funding would interrupt Portland Development Commission's ability to develop rental housing; therefore, this ordinance shall be in force and effect from and after its passage by Council.
