ORDINANCE No. 181517
*Authorize issuance of an Electric Line Easement across certain City property in the vicinity of N Willamette Blvd and N Killingsworth St (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The City of Portland has designed the Combined Sewer Overflow (CSO) project to comply with the Amended Stipulation and Final Order (ASFO) issued by the Department of Environmental Quality, requiring the City to reduce combined sewer overflows to the Willamette River
2. The CSO requires certain electric line services, which are to be provided by the Portland General Electric Company (PGE), in accordance with an agreement between the City and PGE.
3. A portion of the electric service line will cross a portion of City land managed by the Bureau of Environmental Services in the vicinity of N. Willamette Blvd. and N. Killingsworth Street, resulting in the need for the City to grant an easement to PGE.
4. As the electric line is not dedicated exclusively to CSO purposes, PGE was required to pay a fair value for the easement area, with said amount calculated to be $4,830, inclusive of a $500 processing fee.
NOW, THEREFORE, the council directs:
a. That the Bureau of Environmental Services is authorized to issue an easement to PGE in a form substantially the same as Exhibit A attached hereto.
b. The Auditor will forward the fully executed easement to the Right of Way Acquisitions Unit of the Office of Transportation for recording and transmittal to PGE.
Section 2. The Council declares that an emergency exists because the temporary access permit is about to expire and an easement needs to be issued to perform further work and maintenance. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
