ORDINANCE No. 181516
*Authorize issuance of Permanent and Temporary Easements across certain City property in the vicinity of Interstate 5 at the intersections of N Columbia Blvd and N Schmeer Rd (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The Oregon Department of Transportation (“ODOT”) has designed improvements to facilitate the widening of Interstate 5 in the vicinity of N. Columbia and N. Schmeer Road.
2. The improvements require permanent and temporary easements from the City of Portland.
3. ODOT has offered compensation of $16,300 for the permanent and temporary easements as fair market value.
4. ODOT has prepared State’s Obligation Agreements for each site addressing construction and restoration issues. The City accepts the terms of the agreements.
NOW, THEREFORE, the council directs:
a. That the Bureau of Environmental Services is authorized to issue easements to ODOT in a form substantially the same as Exhibit A (permanent easement) and Exhibit B (temporary easement) attached hereto.
b. The Auditor will forward the fully executed easements to the Right of Way Acquisition Section of the Office of Transportation for recording and transmittal to ODOT.
Section 2. The Council declares that an emergency exists because ODOT has designed improvements to facilitate the widening of Interstate 5 and requires Permanent and Temporary Easements across certain City of Portland property in the vicinity of Interstate 5 at the intersections of N. Columbia and N. Schmeer Road to continue this work. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
