ORDINANCE No. 181514

 

*Authorize issuance of an Underground Distribution Line Easement across certain City property located at N. Basin Ave north of N. Leverman St Project No. 5375. (Ordinance)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The City of Portland has designed improvements to the Mocks Bottom Pump Station, requiring an upgrade to the pump station’s electrical system to a 277/480 volt three phase service.

 

2.  These upgrades to the pump station’s electrical system will require improved electric service, which is to be provided by the Portland General Electric Company (PGE), in accordance with an agreement between the City and PGE.

3.  The facilities for this electric service will be located upon a portion of City land managed by the Bureau of Environmental Services at N. Basin Avenue north of N. Leverman Street, resulting in the need for the City to grant an easement to PGE.

4.  Since the facilities for this electric service are not dedicated exclusively to serve the pump station, PGE was required to establish the fair market value for the easement area, being $2,727.00. PGE asks that this compensation price be reduced by the cost of materials and services paid by PGE of $11,938.79 towards the electrical facilities, resulting in a final amount of required compensation for the easement calculated to be $1.00.

NOW, THEREFORE, the Council directs:

 

a.  That the Bureau of Environmental Services is authorized to issue an easement to PGE in a form substantially the same as Exhibit A attached hereto.

b.  The Auditor will forward the fully executed easement to the Right of Way Acquisitions Unit of the Office of Transportation for recording and transmittal to PGE.

 

Section 2.  The Council declares an emergency exists because the easement needs to be granted before PGE will install their facilities for the electrical service upgrade. PGE’s work needs to be completed by February, 2008 or the cost of materials and services will increase. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
