ORDINANCE No.  181502

Amend contract with Portland Streetcar, Inc. to provide additional professional services for project management and vehicle engineering services for production of a domestically manufactured streetcar (Ordinance; amend Contract No. 37119)

The City of Portland ordains:

Section 1. The Council finds:

1.  The production of a domestically manufactured streetcar (Prototype Streetcar Project) is funded by a federal National Research Program grant (Grant), through the Federal Transit Administration (FTA), which calls for not less than $1,000,000 to be made available to TriMet in each of federal fiscal years 2006, 2007, 2008 and 2009.

2.  On March 22, 2006, the City Council passed Ordinance 180018 authorizing an Intergovernmental Agreement (IGA) with the Tri-County Metropolitan Transportation District of Oregon (TriMet) naming the City the sub-recipient of the Grant funds and calling for the City to oversee and carryout the work needed for the Prototype Streetcar Project. There is no local match required.

3.  On November 22, 2006, the City Council passed Ordinance No. 180621 authorizing Contract No. 37119 (Agreement) with Portland Streetcar, Inc. (PSI) for project management and vehicle engineering services for the Prototype Streetcar Project, funded by a portion of the first year federal appropriation.

4.  Ordinance No. 180621 anticipated that the Agreement would be amended in the future as additional federal grant funds became available to TriMet.

5.  TriMet has informed the City that the federal fiscal year 2007 appropriation of funds for the Prototype Streetcar Project has been made and that the FTA has approved TriMet’s grant application, making the funds available to the City.

6.  PSI and the City have successfully negotiated an amendment to the Agreement requesting additional needed services and providing additional compensation in the amount of $184,398.

NOW, THEREFORE, the Council directs:

a.  The Commissioner of Public Utilities and the City Auditor are hereby authorized to enter into Amendment No. 2 to Contract No. 37119, substantially in accordance with the Amendment attached to the original of this Ordinance and, by reference, made a part hereof.

b.  The Mayor and Auditor are hereby authorized to draw and deliver checks payable to Portland Streetcar, Inc. chargeable to the Transportation Operating Fund, AU 159.

c.  The City’s Project Manager is hereby authorized to agree to and execute, on behalf of the City, any amendment that does not increase the amount of the Contract.
