ORDINANCE No. 181497

*  Approve ratification of a purchase agreement with Exercise Equipment Northwest for exercise equipment at a value of $26,528 (Ordinance)

The City of Portland ordains:

Section 1. The Council finds:

1.  Portland Fire & Rescue (PF&R) requires its firefighters to be in excellent physical condition because of the extreme demands of the job. In order to train effectively and efficiently, all fire stations have exercise equipment for firefighters’ use to increase their strength, endurance, and aerobic capacity. In addition, due to the increased number of firefighter recruits, equipment was needed at the Training Academy.

2.  PF&R, in good faith, purchased the equipment from a vendor that had previously been identified through the competitive bid process as being able to meet all the equipment durability and delivery requirements. However, following the delivery and installation of the equipment PF&R determined that it should have used another competitive bid process for this purchase.

3.  Subsequently, PF&R began working with the Bureau of Purchases to determine how best to proceed. The Bureau of Purchases recommended that the purchases from that vendor be ratified by Council. This ordinance requests that ratification.

4.  It is in the public interest of the City and its citizens to continue the fitness program for fire personnel and retain the already purchased equipment.

NOW, THEREFORE, the Council directs:

a.  The Commissioner of Public Works and the Auditor are hereby authorized to draw and deliver, to Exercise Equipment Northwest, for exercise equipment already delivered, a warrant in an amount not to exceed $26,528.30, chargeable to the 2007-208 Portland Fire & Rescue budget.

Section 2. The Council declares that an emergency exists because the equipment has been delivered and is currently in use by fire personnel; therefore, this Ordinance shall be in force and effect from and after its passage by Council
