ORDINANCE No. 181492
*Amend an Interagency Agreement with the Portland Development Commission to provide professional, technical and construction services for transportation improvements in FY 2007-08 (Ordinance; amend Contract No. 52651)
The City of Portland ordains:
Section 1. The Council finds:
1. The Portland Office of Transportation (PDOT) in partnership with the Portland Development Commission (PDC) are planning, developing, and implementing transportation improvements within the designated urban renewal districts.
2. PDOT and PDC, under their respective charter authorities, are authorized to enter into cooperative agreements for the improvement of the community.
3. PDC desires to use the professional and technical service of PDOT in order to efficiently plan, design, and construct transportation and other street improvements.
4. By Ordinance No. 180165, passed by Council on May 24, 2006, Council authorized an Interagency Agreement with the Portland Development Commission for an amount not to exceed $13,713,551.
5. PDOT and PDC are working to update the template used for future Interagency Agreements; however, PDOT and PDC are also concurrently continuing project work, all within the budget authorized by Ordinance No. 180165.
6. The purpose of this amendment is to extend the termination date of last year’s Interagency Agreement from June 30, 2007 to February 29, 2008, allowing PDOT to bill and PDC to pay for services received through February 2008.
NOW, THEREFORE, the Council directs:
a. That the Commissioner-in-Charge and Auditor are authorized to execute Amendment No. 1 to the Master Interagency Agreement with the Portland Development Commission, dated June 29, 2006, similar in form to the amendment attached to the original of this Ordinance, and by this reference made a part hereof.
Section 2. The Council declares that an emergency exists because a delay in amending the Interagency Agreement would delay reimbursement of PDOT by PDC for services received and costs incurred; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
