Pursuant to Ordinance No.        

  The CITY OF PORTLAND, OREGON, 1120 SW Fifth Ave., Portland, Oregon 97204, by and through its duly authorized representatives (City), and OREGON IRON WORKS, INC., 9700 S. E. Lawnfield Road, Clackamas, Oregon 97015, a corporation formed under the laws of Oregon (“Contractor”) agree as follows:

1.  Contractor agrees to provide the services and materials required by the Contract Documents in the  time required by the contract schedule.

2.  The City agrees to pay a sum not to exceed $3,200,000 to the Contractor for the contract work, with compensation dependent on federal appropriations and other conditions as set forth in this Contract and RFP No. 105620.

3.  The Contract Documents consist of the General Conditions, Attachment A; the Technical Specifications, Attachment B; the Special Provisions, Attachment C; the Schedule, Attachment D; the City’s Request for Proposals, #105620, Attachment E; the Contractor’s proposal in response to the City’s Request for Proposals, Attachment F; and the conditions applicable to public contracts, Appendix A.

4.  Any reference in this contract to the specifications is intended as a convenience to the parties in administration of the contract. Therefore, in the absence of an express statement to the contrary herein, any restatement or partial restatement in this contract of any provision of the specifications is not intended, nor shall be construed to change, alter, modify, amend, or delete the requirements of the specifications.

5.  All statutory, charter and ordinance provisions applicable to public contracts in the City of Portland and State of Oregon shall be followed with respect to this contract.
