ORDINANCE NO. 180748

 

* Amend contract for services with the Regional Arts & Culture Council to administer public art matters for the City and provide for payment (Ordinance; amend Contract No. 52552)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The City, under Ordinance 168387, approved an intergovernmental agreement with Multnomah, Washington, Clackamas and Clark Counties and Metro designating the Regional Arts & Culture Council (RACC) as the arts and cultural agency for the region.

 

2.  The City entered into subsequent agreements in 1995 and 2000 with RACC to provide oversight and review of public art matters and other services for the City of Portland as outlined in the agreements.

 

3.  RACC has demonstrated its expertise through these prior Agreements with the City and prior as the Metropolitan Arts Commission.

 

4.  RACC is a non-profit corporation organized for the primary purpose of the stewardship of public investment in arts and culture.

 

5.  The City values public art and the promotion of culture as central to Portland’s quality of life.

 

6.  City of Portland Adopted Budget 2006/07 appropriates $300,000 in additional ongoing resources to RACC to “make all arts funding decisions on behalf of Council and to entrust RACC with the responsibility of comprehensive support for and communication with the city’s vibrant and diverse arts and culture community;”

 

7.  City of Portland Adopted Budget 2006/07 directs Council staff and RACC to “work to amend the current RACC contract to further empower RACC to make decisions on behalf of Council and to entrust RACC with the responsibility of comprehensive support for, and communication with, the city's vibrant and diverse arts and culture community…The $300,000 ongoing additional funding may be disbursed to RACC upon Council approval of the amended contract.”

 

8.  City of Portland Adopted Budget 2005/06 directed the Bureau of Licenses (now Bureau of Revenue) to amend Administrative Rule 610.93-4 to eliminate the project-by-project apportionment option of business license fee calculations. Increased revenue resulting from this amendment, estimated at $200,000 per year, will begin to be collected in FY 2006-07.

 

 

9.  City Council has pledged to match each dollar contributed to Work for Art, a campaign of RACC, by June 30, 2007, up to $200,000 using, in part or in whole, increased revenue resulting from the amendment of Administrative Rule 610.93-4;

 

 

NOW, THEREFORE, The Council directs:

 

a.  The Commissioner of Public Utilities and Auditor are hereby authorized to execute an amended agreement with the Regional Arts & Culture Council substantially in accordance with the form of agreement attached as Exhibit A (contract amendments) and Exhibit B (original contract) to this Ordinance;

 

b.  The Mayor and Auditor hereby are authorized to draw and deliver checks chargeable to the FY 2006-2007 Budget, Account 529000, Center Code 40101002 and subsequent Budgets and Special Appropriations as approved by Council;

 

c.  The Mayor and Auditor hereby are authorized to draw and deliver checks chargeable

to the FY 2006-2007 Budget up to $200,000 of additional funding to RACC using in

part or in whole, increased revenue resulting from the amendment of Administrative

Rule 610.93-4, to match donations to Work for Art;

 

d.  The Mayor and Auditor hereby are authorized to draw and deliver checks chargeable

to the FY 2006-2007 Budget to the Regional Arts & Culture Council to fulfill

Special Appropriations of one-time funds to the Portland Jazz Festival and Oregon

Historical Society through the Regional Arts & Culture Council.

 

e.  The Office of Management and Finance is directed to include future $200,000 grant \

match budget in each financial forecast as one-time discretionary budget for RACC.

The city will disburse funds from the budget as required by RACC’s submittal of

invoices.

 

Section 2. The Council declares that an emergency exists because delay in funding would prevent RACC’s ability to fulfill grant and special appropriation obligations; therefore, this ordinance shall be in full force and effect from and after its passage by Council.
