ORDINANCE No. 180743 AS AMENDED

 

Revise provisions relating to prohibited conduct in Parks (Ordinance; repeal and replace Code Chapter 20.12)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

1.  It is of vital importance to the people of the City of Portland to preserve their Parks for the enjoyment, safety, comfort and convenience of the public.

2.  It is necessary to prohibit certain conduct in the Parks that unreasonably interferes with the orderly administration and lawful use of the Parks, in order to maintain the Parks as safe, welcoming and inviting places for the general public.

3.  The City Attorney’s Office, in consultation with Portland Parks and Recreation, the Portland Police Bureau, the District Attorney’s Office and other interested parties, has reviewed the existing regulations in Chapter 20.12 of the City Code, and recommends that changes be made to streamline, modernize, clarify, and promote the enforceability of its provisions.

NOW, THEREFORE, the Council directs:

 

a.  PCC Chapter 20.12 is repealed and replaced with a new Chapter 20.12, as set out in Exhibit A to this Ordinance.

b.  Nothing in the repeal or replacement of Chapter 20.12 or otherwise in this Ordinance shall adversely affect the validity of any notice, warning, exclusion, prosecution or conviction based on conduct occurring before the effective date of this Ordinance; but all exclusions in effect as of the effective date shall remain in effect until by their terms they expire, and all warnings and exclusions issued before the effective date of this Ordinance shall otherwise have the same effect as if they had been issued on or after the effective date of this Ordinance.
