ORDINANCE No. 180733

 

* Extend Intergovernmental Agreement with Multnomah Educational Service District for participation in the Integrated Regional Network Enterprise (Ordinance; amend Contract No. 51717)

 

The City of Portland Ordains:

 

Section 1: The Council Finds:

 

1.  The Integrated Regional Network Enterprise (IRNE) is an initiative of the Portland City Council to provide very high bandwidth, high reliability and highly secure telecommunications services for the City of Portland.

 

2.  The IRNE is intended by the City Council to serve other local jurisdictions, State and Federal agencies, educational institutions and public safety providers in the region.

 

3.  Other agencies in the region have expressed interest in entering into intergovernmental agreement with the City of Portland for access to IRNE services. The participation of other local jurisdictions, State and Federal agencies, educational institutions and public safety providers in the region is critical to the success of the IRNE.

 

4.  The Bureau of Communications and Networking (ComNet) (now a division of the Bureau of Technology Services) was authorized by Council on May 24, 2000 (Resolution # 35888) to negotiate Intergovernmental Agreements with other local jurisdictions, State and Federal agencies, educational institutions and public safety providers in the region for IRNE services.

 

5.  MESD wishes to continue participation in IRNE for a subsequent five (5) year period through Amendment to City or Portland IGA #51717 which is within the City’s not to exceed policy of an aggregate of ten (10) years in total.

 

6.  This Intergovernmental Agreement is authorized pursuant to Chapter 190 of Oregon Revised Statutes and Section 2-105 (a) 4 of the Charter of the City of Portland.

 

NOW, THEREFORE, the Council directs:

 

a.  The Mayor and the City Auditor are authorized to execute on behalf of the City of Portland, an Amendment to Intergovernmental Agreement #51717 to extend it expiration date to January 27, 2012 for participation in IRNE services with MESD substantially in the form attached to the original of this Ordinance, and by reference made a part hereof.

 

b.  The Chief Administrative Officer is hereby authorized to execute amendments to the Intergovernmental Agreement with MESD. The City Attorney shall approve all amendments as to form prior to their execution.

 

Section 2:  The Council Declares that an emergency exists because it is important to support the MESD in documenting its Federal eRate Application Deadlines for continued funding and participation in the IRNE; therefore, this Ordinance shall be in force and effect from and after its passage by Council.
