ORDINANCE No. 180716

 

*Amend Intergovernmental Agreement with Multnomah County to provide roadway maintenance services West of the Willamette River (Ordinance; amend Contract No. 51062)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The City of Portland (City) has provided road and drainage services to certain areas of unincorporated Multnomah County (County), via Ordinance No.155651 passed by Council on March 1, 1984.

 

2.  The original service agreement did not provide for financial remuneration to the City because the areas were to be annexed to the City. However, annexation of the western areas has been slower than anticipated in 1984; and the County has been informed that the City can longer provide services without financial remuneration.

 

3.  Both the City and the County agree that it is most efficient for the City to continue providing road and drainage facility maintenance to these areas via Ordinance No. 177777, passed by Council on August 13, 2003.

 

4.  The agreement has been amended to include language for the City of Portland Stormwater Management Plan for Underground Injection Control Devices and to provide reimbursement from Multnomah County to the City up to the amount of $158,000, including $3,500 for snow and ice response, in the County’s western service areas, for the 2006-07 fiscal year.

 

5.  The Bureau’s level of confidence in the cost estimate for this agreement is high.

 

NOW, THEREFORE, Council directs:

 

a.  The Commissioner of Public Utilities and the City Auditor are hereby authorized and directed to execute an amendment to Contract No. 51062 with Multnomah County to provide financial remuneration for roadway maintenance services to certain county roads west of the Willamette River, said agreement to be substantially in conformance with Exhibit A, attached and by reference made a part of this ordinance.

 

Section 2. The Council declares that an emergency exists because the City will begin providing maintenance services on July 1, 2006; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
