FIELD EXPERIENCE AGREEMENT
for
PARAMEDIC PROGRAM STUDENTS
This is an Agreement between College of Emergency Services (CES), a private institution in Beaverton, Oregon, hereinafter called “COLLEGE” and the City of Portland, Bureau of Fire, Rescue & Emergency Services, located in Portland, Oregon, hereinafter called “CITY” to facilitate Field Experience for qualified COLLEGE Paramedic Program Students. No term or condition of this agreement guarantees any COLLEGE student working towards certification that the program in which they are participating will continue until they have received their certification as the CITY may terminate any program as the CITY, in its sole discretion, deems necessary for the benefit of the CITY.
RECITALS:
WHEREAS, COLLEGE operates an accredited Paramedic Program that educates and trains students, hereinafter called “Students,” and it is intended to provide Students with a variety of learning experiences, including participation in Field Experiences outside the COLLEGE; and
WHEREAS, COLLEGE can improve the quality of its Paramedic Program if it is affiliated with CITY for Field Experiences; and
WHEREAS, CITY can provide a portion of COLLEGE’S Paramedic Program Field Experiences for Students; and
WHEREAS, CITY is willing to accept and COLLEGE is willing to assign Students to participate in the Paramedic Program Field Experience at CITY;
NOW THEREFORE, in consideration of the foregoing recitals and the mutual covenants and promises, and upon the terms and conditions hereinafter set forth, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:
1.0 FIELD EXPERIENCE TRAINING
1.1 This Agreement sets forth the general procedures and understanding for implementing the agreed Field Experience Training.
1.2 COLLEGE and CITY shall jointly agree to specific and detailed information concerning the number of Students to be assigned to receive Paramedic Program Field Experience under this Agreement, the terms and conditions of Students’ assignments, instruction schedules, evaluations, and program educational goals and objectives, the planning and coordination of the prescribed content, and the length of time required for the Field Experience Training.
1.3 The COLLEGE shall select Students to be assigned to CITY for Field Experience Training and shall designate a faculty member to supervise the assigned Students.
1.4 Assigned Students shall participate in the Paramedic Program Field Experience at CITY and its locations, including but not limited to fire departments.
1.5 It is agreed that COLLEGE’S Field Experience Training will not interfere with necessary City operations.
1.6 CITY has authority to refuse to work with any student it deems disruptive or who refuses to follow CITY direction at any time before or during the training.
2.0 COLLEGE RESPONSIBILITIES:
2.1 COLLEGE shall design and implement a Field Experience Program that meets current State Certification for Emergency Medical Technology (EMT) basic, Intermediate, and Paramedic levels. CITY will have the right to review, for the CITY’S own purpose, the Field Experience program before implementation.
2.2 COLLEGE shall, at periodic intervals, review the content and quality of the Field Experience Training covered by this Agreement. Such review may include a site visit. If such visit raises any issues for COLLEGE, then COLLEGE may contact CITY for further discussions. CITY shall meet with COLLEGE, if so requested.
2.3 COLLEGE shall designate a COLLEGE Program Director as liaison with CITY. The Program Director shall:
2.3.1 Provide a list of assigned Students and training schedules to CITY.
2.3.2 Evaluate whether in the COLLEGE’S opinion that the student and CITY Preceptor are well-matched.
2.3.3 Conduct seminars for Students’ orientation and scheduling.
2.3.4 Monitor Students progress toward stated objectives.
2.3.5 Receive and review objective input from CITY regarding Students’ performances and progress.
2.3.6 Conduct site visits with CITY for the purpose of monitoring Students’ progress, problem solving, and upgrading of the Field Experience program.
2.4 COLLEGE shall assign only those Students who have satisfactorily completed the prerequisite didactic, lab and hospital clinicals as recommended by the COLLEGE Program Director.
2.5 COLLEGE shall provide CITY with information on the skill training and level of assigned Students. City shall rely upon College’s decision regarding student skill and training levels.
2.6 COLLEGE shall assign only those Students who provide proof of current immunizations, e.g., TB, Tetanus, MMR and Hepatitis B series.
2.7 COLLEGE shall obtain and continue in force during the terms of this Agreement professional liability coverage for protection of its assigned Students and faculty, and Workers’ Compensation coverage in compliance with ORS 656.046. COLLEGE shall furnish CITY with a Certificate of Insurance upon request. COLLEGE shall provide CITY with thirty (30) days written notice prior to reduction or cancellation of these policies.
2.8 COLLEGE shall indemnify and hold harmless CITY, its officers, employees and agents from all claims, suits, and actions of whatsoever nature resulting from or arising out of the activities of COLLEGE or its elected directors, officers, employees or Students acting under this Agreement.
2.9 By signing this Agreement, COLLEGE’S delegated authority authorizes its Students to participate in the Field Experience Training with CITY pursuant to this Agreement.
3.0 STUDENTS’ RESPONSIBILITIES - The COLLEGE will be responsible for overseeing and ensuring the following student responsibilities:
3.1 Students shall retain their status as Students of COLLEGE while assigned or rotated to CITY hereunder. Students assigned to CITY shall at no time be considered employees of CITY nor shall they have any of the rights or benefits of employees of the City.
3.2 Students shall provide CITY, upon request, appropriate proof of current immunizations, CPR training and any certification as required by COLLEGE’S Emergency Medical Service and/or CITY. COLLEGE shall verify Students’ documented proof of immunizations on COLLEGE letterhead to CITY.
3.3 Students shall report all body fluid splashes, needle sticks, and other accident or event occurring during Field Experience Training that could endanger their health to CITY and COLLEGE immediately. In the event of a blood/body fluid exposure, CITY may do an initial assessment of the Student’s exposure. If emergent treatment (e.g. Hepatitis B Immune Globulin or initial doses of antiretroviral therapy) is indicated, Student may be admitted to Emergency Care for immediate post-exposure management. Treatment and/or
follow-up care must be reported to COLLEGE. Except herein provided,
CITY shall have no further obligation to furnish medical or surgical care to Student. CITY is not responsible for Student’s medical care expense.
3.4 Students shall provide their own uniforms and transportation. Such uniforms shall, in no way, be labeled in a way that indicates or suggests that the student is a CITY employee or agent.
3.5 Students shall be informed in advance of dates and times for attendance and shall report on time and as scheduled.
3.6 Students shall abide by COLLEGE and CITY dress code limitations, including but not limited to, body piercing, jewelry, hairstyle and length, facial hair, etc. Dress code requirements shall be included in COLLEGE’S instructions to Students.
3.7 While participating with CITY for paramedic field training activities, Students shall observe any and all CITY rules and regulations relating to its facilities and shall not act in a manner contrary to the practice agreement they have signed or any clause of this Agreement.
3.8 Students shall adhere to confidentiality policies of CITY by maintaining the confidentiality of all patient information, including the discussion, transmission or narration in any form of any patient information of a personal nature, medical or otherwise. If required by CITY, Students shall sign the appropriate Confidentiality Statement form.
3.9 Students shall be required to obtain prior written approval from both COLLEGE and CITY before publishing, either printed or electronically transmitted, any material relating to the Field Experience Training or experience.
3.10 Students shall sign a waiver prior to participation in the program which expressly accepts the physical risks associated with such training, expressly states that the student has no reason to believe that the student is not physically able to fully participate in the training, expressly states that the student has no undisclosed condition which would suggest that it would be unwise to participate in any part the training, expressly states that the student is participating as a student and has no direct relationship to or rights against the City related to participation or evaluations and expressly states that the student will inform the COLLEGE supervisor and a City representative if not feeling well.
4.0 CITY RESPONSIBILITIES:
4.1 The following CITY obligations shall apply when the CITY has determined to participate in this Paramedic Field Experience Training Program. The CITY may also determine in its sole discretion, not to participate in this program if it deems necessary for the benefit of the CITY.
4.2 CITY shall provide Students’ access to the Portland Fire & Rescue Exposure and Control Plan to familiarize Students with the CITY’S Bloodborne Pathogen awareness procedures
4.3 It is mutually agreed that by the terms of this Agreement, CITY has not granted or delegated any of CITY’S powers, statutory, implied, administrative, medical or otherwise, to COLLEGE and that the treatment of its patients and the use of its equipment, or the hiring, acceptance and assignment of its personnel, will be and does remain within the jurisdiction of CITY.
4.4 Where possible, CITY shall provide Students with conference and/or classroom space, lounge and locker space as available. CITY library and such appropriate reference books and procedure manuals as are available and pertinent to the Field Experience Training may be available for Students’ use.
4.5 CITY agrees to name Preceptors for each Student to monitor and supervise Students’ Field Experience Training.
4.6 CITY Preceptors shall be currently certified paramedics and shall be acceptable to COLLEGE.
4.7 CITY Preceptors shall notify COLLEGE’S Program Director of any problem with a Student’s performance.
4.8 CITY Preceptors shall monitor Students’ objective learning goals, as provided by COLLEGE, and shall complete daily Student evaluations and mid-term and end-of-term evaluations based upon CITY’s objective observations.
4.9 CITY shall provide prompt review of pre-hospital care provided by Students.
4.10 CITY shall hold and maintain in confidence all Students’ records and evaluations to the extent permitted by law.
4.11 CITY shall report to COLLEGE’S Course Director any injury or any accident as soon as possible but not to exceed forty-eight (48) hours.
5.0 SPECIAL CONTRACT CONDITIONS
5.1 AFFIRMATIVE ACTION AND NONDISCRIMINATION
5.1.1 COLLEGE is obligated by the laws and regulations of the federal Government regarding Equal Employment Opportunity and Affirmative Action (Public Law 101-336). There shall not unlawfully discriminate against any person in the Field Experience training program because of age, handicap, marital status, race, color, creed, sex, sexual orientation, religion, national origin, or any other unlawful reason.
5.2 FORCE MAJEURE:
5.2.1 Neither COLLEGE nor CITY shall be liable for any failure or delay in performing their obligations hereunder, or for any loss or damage resulting therefrom, due to:
5.2.1.1 An act of God, act of government, war, riot, embargo, act of civil or military authority, fire, flood, earthquake, volcanic activity, accident, strike, epidemic or unusually severe weather affecting either party;
5.2.1.2 Causes beyond their control and which are not foreseeable.
5.2.1.3 As soon as practicable thereafter, however, any payments due shall be made and training shall continue if COLLEGE desires training to continue and if CITY determines that it will continue the training.
5.3 NOTICES:
Any notice required to be given pursuant to this Agreement shall be in writing, dated and addressed to both parties as follows:

5.4 AMENDMENTS:
CITY and COLLEGE may amend this Agreement by written agreement only executed by those authorized by CITY and COLLEGE to approve such amendments.
5.5 TERMINATION:
5.5.1 This Agreement may be terminated by the CITY at will as it, in its sole discretion, deems necessary.
5.5.2 Unless otherwise agreed, termination of this Agreement may be effected only at the conclusion of an academic year thus giving Students participating in the Field Experience Training the opportunity to finish their rotation and/or certification.
5.5.3 Notwithstanding the foregoing, either party may terminate this Agreement for a substantial breach of the Agreement, after giving the other party notice of the breach and a reasonable opportunity, not to exceed thirty (30) days, to correct the breach.
5.5.4 CITY may terminate any student’s access to their facilities in connection with the clinical or educational experience at any time with or without cause. CITY may give oral notice to the student of such termination; written notice shall not be required. Student will leave the premises immediately if requested to do so. The COLLEGE will be immediately notified of the termination.
5.6 VENUE:
This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon. Any claim, action, or suit between COLLEGE and CITY that arises out of or relates to performance of this Agreement shall be brought and conducted solely and exclusively within the Circuit Court of Multnomah County, for the State of Oregon. Provided, however, that if any such claim, action or suit may be brought only in a federal forum, it shall be brought and conducted solely and exclusively in the United States District Court for the District of Oregon.
5.7 COMPENSATION:
In return for services rendered the COLLEGE shall pay the CITY the agreed fee, not to exceed One Hundred Twelve Dollars and Thirty-One cents ($112.31) per student, per week. CITY will invoice COLLEGE at the end of the internship or prior to end of fiscal year (June 30), whichever comes first. The invoice shall be payable within 30 days.
5.8 TERM OF AGREEMENT:
This Agreement shall be effective from the date of the last signature below, and shall continue in effect for a period of five (5) years, with an option to renew for an additional five (5) year period, unless terminated as specified in paragraph 5.5 above.
6.0 ENTIRE AGREEMENT:
6.1 This Agreement constitutes the entire Agreement between both parties. There are no understandings, representations, agreements or communications, oral or written, not specified herein regarding this Agreement. By the signature below of its authorized representative, each party acknowledges that they have read and understand this Agreement and the parties agree to be bound by its terms and conditions.
