ORDINANCE No. 180709
*Authorize an addendum to Intergovernmental Agreement with Oregon Health Sciences University to designate person in charge authority for Portland Aerial Tram operations (Ordinance; amend Contract No. 52689)
The City of Portland ordains:
Section 1. The Council finds:
1. The City entered into an Intergovernmental Agreement No. 52689, August 17, 2006, with the Oregon Health Sciences University (OHSU) for operation of the Portland Aerial Tram.
2. The existing agreement contemplated that OHSU would provide security for the Portland Aerial Tram.
3. Notwithstanding Portland City Code 5.36.115, the Council’s designation of “person in charge” as that term is defined in ORS 164.205(5) to OHSU with respect to the Tram and Tram Stations would facilitate the effective enforcement of Tram rules and regulations and prosecution of criminal trespass matters.
4. Effective management of the Tram and Tram Stations would be furthered by authorizing the OHSU President and the President’s designee to be the “person in charge” with respect to the Tram and Tram Stations.
NOW, THEREFORE, the Council directs:
a. The Mayor and City Auditor are authorized to enter into the Addendum to the Intergovernmental Agreement with the Oregon Health Sciences University, in a form substantially in accordance with the agreement attached as Exhibit A.
Section 2. The Council declares that an emergency exists because it is critical that the City enter into an IGA designating “person in charge” status before the Portland Aerial Tram opens for public use; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
