ORDINANCE No. 180702

 

* Authorize two Intergovernmental Agreements with the Tri-County Metropolitan

Transportation District to have Equal Employment Opportunity and Workforce Program

requirements on the Commuter Rail Project and South Corridor Light Rail Project (Ordinance)

 

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1.    The Bureau of Purchases administers the City’s Equal Employment Opportunity (EEO)  Program and its Workforce Training & Hiring Program (Workforce). The Workforce  Program requires the use of apprentices on many city construction projects.

 

2.    The Tri-County Metropolitan Transportation District (TriMet) wants to have EEO and  Workforce requirements on two of its upcoming construction contracts, the Commuter  Rail Project and the South Corridor Project, including the I-205 segment and the Portland  Mall segment.

 

3.    TriMet seeks to utilize the Bureau’s expertise in administering both the EEO and  Workforce Programs, which will avoid unnecessary duplication, efforts and expense.  The proposed Intergovernmental Agreements are attached as Exhibits A and B to this  ordinance.

 

4.    The Commuter Rail Project requires the payment of $10,000 by TriMet to the City. The  South Corridor Light Rail Project requires the payment of $17,500 to the City, both for  the period beginning January 1, 2007.

 

5.    The Director of the Bureau of Purchases is authorized to amend these agreements  provided the risk to the City does not change. In addition, the Director is authorized to  extend the term of these agreements, providing TriMet provides additional  compensation  to the City, in the event that TriMet does not assume these duties on July 1, 2007, as  currently anticipated.

 

NOW, THEREFORE, the Council directs:

 

a.  The Mayor and Auditor are hereby authorized to execute the Intergovernmental Agreements with TriMet in a form substantially similar to that contained in Exhibits A and B.

 

b.  The Director of the Bureau of Purchases is authorized to amend these agreements provided there is not additional financial risk to the City and may extend these agreements for an additional term provided that the City is appropriately compensated for its services.

 

 

Section 2. The Council declares that an emergency exists because the City needs to provide these services on or after January 1, 2007; therefore this ordinance shall be in full force and effect from and after its passage by the Council.
