ORDINANCE No. 180690
* Establish a new City bureau known as the Bureau of Portland Fire and Police Disability and Retirement. (Ordinance; add Code Chapter 3.127)
The City of Portland ordains:
Section 1. The Council finds:
1. Chapter 5 of the Charter of the City of Portland, the Portland Fire and Police Disability and Retirement Fund (“FPDR”), provides retirement and disability benefits for the sworn officers of the Bureau of Fire, Rescue and Emergency Services and the Bureau of Police of the City of Portland, and their surviving spouses and dependent minor children.
2. On June 14, 2006, the City Council referred a series of charter amendments to the voters to reform the current FPD&R system.
3. On November 7, 2006, the voters overwhelmingly approved these changes, with a 81.61% yes vote; and
4. The charter amendments called for a series of significant changes, including making the Administrator of the FPDR a Bureau Director and requiring that the staff of FPDR report to the Board of Trustees of the Fund as well as the Mayor.
5. This ordinance is necessary to implement these changes as directed by the will of the voters.
NOW, THEREFORE, the Council directs:
a. Title 3 of the City Code is amended by the addition of a new City bureau, known as the Bureau of Portland Fire and Police Disability and Retirement as shown in Exhibit A to the Ordinance.
Section 2. The Council declares that an emergency exists because the amendments to Chapter 5 of the Charter become effective on January 1, 2007, and the new bureau needs to be established clarifying its roles and responsibilities; therefore, this ordinance shall be in full force and effect from and after its passage by Council.
