ORDINANCE No. 180679
* Authorize an agreement with Brigitte Kolloch-Russell and Andrew K. Russell for sanitary service and connection to a pressure pipeline at SW Cascade Terrace, Project No. 8139 (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. Brigitte Kolloch-Russell and Andrew K. Russell are constructing a residential home on lot 4 of Krebs Addition at 3237 SW Cascade Terrace.
2. There is no gravity sewer available to this site. This area is served by a Septic Tank Effluent Pumping Station (STEP) system.
3. The City agreed to the sanitary sewer connection to the pressure pipeline that discharges into the City’s sewer collection and conveyance system.
4. Per the DEQ rules, the City is responsible for the operations and maintenance of the pump system for this property. In order to meet the DEQ requirements, the City will provide the services for this connection, which include operation and maintenance services, engineering functions necessary to repair and replace components of the tank pumping, electrical and instrumentation systems, and regulatory management services to protect the system and the environment.
5. The property owner will reimburse the City for these services because the level of service provided is greater than that provided to a typical property connected to the public gravity sewer system.
6. The City agrees to accept this sewer connection in accordance with the terms of the agreement attached.
NOW, THEREFORE, the council directs:
a. The Director of the Bureau of Environmental Services is authorized to sign an agreement substantially in accordance with Exhibit A for the purpose described in Section 1.
Section 2. The Council declares that an emergency exists because the building is under construction and failure to pass this ordinance as an emergency will delay their project. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
