Resolution No. 36390 AS AMENDED
Authorize City Attorney to exercise City authority to subpoena documents to determine terms and conditions of PGE electric utility services within the municipal boundaries of the City pursuant to ORS 221.420(2)(c) (Resolution)
WHEREAS, the Portland City Council passed Resolution 36370 requesting information from Portland General Electric to resolve concerns regarding Portland General Electric’s rate setting, tax collection, tax payment, and accounting practices; and
WHEREAS, the City of Portland submitted a written request for information to Portland General Electric on January 27, 2006; and
WHEREAS Portland General Electric refused the Portland City Council’s request for information; and
WHEREAS the Portland City Council is authorized to permit the City Attorney to subpoena documents and compel testimony by Sections 2-109 and 10-106 of the Portland City Charter, and Portland City Code 3.04.010; and
NOW, THEREFORE, BE IT RESOLVED, the City Attorney is hereby directed by the Portland City Council to issue one or more subpoenas to Portland General Electric for the production of books, documents, and other materials relating to information sought in the Second City of Portland Request for Information and Documents Regarding Portland General Electric, dated January 27, 2006. A copy of the Second Request is attached to this Resolution. The authority granted by the City Council to the City Attorney by this Resolution is in exercise of the Council’s authority under Sections 2-109 and 10-106 of the Portland City Charter, and Portland City Code 3.04.010.
