RESOLUTION No. SUBSTITUTE 36371
Establish a Fire and Police Disability and Retirement Reform Committee to propose changes to the current disability and pension systems for City Council referral to voters in November 2006 General Election (Resolution).
WHEREAS, the City of Portland is grateful for the work that police officers and fire fighters do to keep our city and its residents safe; and
WHEREAS, the City of Portland affirms its commitment to providing a fair retirement and disability system for its firefighters and police; and
WHEREAS, the City of Portland reaffirms the need to reform the current Fire and Police Disability and Retirement system, including aspects of both the pension program and the disability program;
WHEREAS, on February 9, 2005 Portland City Council adopted Resolution #36291 which established the Independent Review Committee (IRC) to conduct a comprehensive analysis of the City’s Fire and Police Disability and Retirement system; and
WHEREAS, on December 20th, 2005 the IRC provided Council with a final report suggesting changes to the pension and disability programs managed by the Fire and Police Disability and Retirement system.
NOW THEREFORE, BE IT RESOLVED that the City of Portland will establish a Fire and Police Disability and Retirement Reform Committee.
BE IT FURTHER RESOLVED that the charge of the Fire and Police Disability and Retirement Reform Committee shall be to work collaboratively to draft comprehensive reform recommendations addressing both pension and disability programs of the Fire and Police Disability and Retirement system. The recommendation will be forwarded to the City Council for referral to the voters as a Charter amendments at the November 2006 General Election.
BE IT FURTHER RESOLVED that the Fire and Police Disability and Retirement Reform Committee shall use the IRC Report, along with outstanding transition and implementation issues identified in Councils’ three work sessions, as a basis for discussions. The “Areas of Agreement”, and the “Areas in Need of Further Clarification” identified at the stakeholders meeting of January 6, 2006, will frame the discussions. Committee meetings will follow the same collaborative model. Notes of the January 6th meeting are attached as Exhibit A.
BE IT FURTHER RESOLVED that the Fire and Police Disability and Retirement Reform Committee shall report back to Council by May 1, 2006. The Fire and Police Disability and Retirement Reform Committee may request an additional 30 days from Council to conduct its work, but its work must be completed no later than June 1, 2006
BE IT FURTHER RESOLVED that the membership of the Fire and Police Disability and Retirement Reform Committee shall consist of:
1. The citizen member of the FPD&R Board of Trustees who is nominated by the Mayor and appointed by Council, Charles Rosenthal.
2. Two representatives of the Portland Police Association, to be selected by the association.
3. Two representatives of the Portland Firefighters Association, to be selected by the association.
4. A representative of the Portland Police Commanding Officers Association, to be selected by the association.
5. Three independent citizen representatives of the Independent Review Committee for FPD&R, Chair Jeff Furnish, Judy Clark and Judith Rice.
6. A representative of the City Club of Portland, to be appointed by the Mayor.
7. Representatives from the offices of the Mayor, the members of Council, and the City Auditor.
BE IT FURTHER RESOLVED that the facilitation of the Fire and Police Disability and Retirement Reform Committee shall be conducted by Shannon Callahan and staffed as needed by members of City of Portland and FPD&R staff at the direction of the Fire and Police Disability and Retirement Reform Committee in conjunction with the facilitator. The City of Portland staff shall include, but is not limited to employees of the Police Bureau , Fire Bureau, Bureau of Human Resources, City Attorney’s Offices, Risk Management, and Office of Management and Finance.
BE IT FURTHER RESOLVED that all of the meetings of the Fire and Police Disability and Retirement Reform Committee shall be open to the public.
BE IT FURTHER RESOLVED that Council commits to referring City Charter reforms to the pension and disability program to the voters for the November 2006 General Election.
