ORDINANCE No. 179893
* Authorize a Shared Use Agreement between the Woodstock Neighborhood Association, the Office of Neighborhood Involvement and the Bureau of Parks and Recreation for Woodstock Community Center (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The City of Portland owns and has assigned to Portland Parks and Recreation (PPR) property at 5905 SE 43rd Avenue, Portland, Oregon, more commonly known as Woodstock Community Center (WCC).
2. PPR scheduled closure of WCC to public use at the beginning of FY 2004-2005 due to lack of budgeted financial resources.
3. At that time, the Woodstock Neighborhood Association (WNA)/ Friends of the Woodstock Community Center (FWCC), desired to ensure the continued operation of WCC and agreed to assume responsibility for performance and associated costs of routine maintenance. They kept the facility open under a previous version of this agreement, as adopted by City Council in Ordinance # 178829;
4. All parties (PPR, WNA, FWCC, and the Office of Neighborhood Involvement) to that previous Shared Use Agreement wish to continue this relationship, and have accordingly negotiated a new Shared Use Agreement intended to run through the end of fiscal year 2007-2008.
5. The City of Portland Office of Neighborhood Involvement (ONI) continues to desire to utilize the premises for office space to accommodate local field staff and agreed to finance operations of WCC as rent for office space up to $2,200 in FY 2005-06, increasing by $100 each following fiscal year.
6. WNA/FWCC has agreed to do fundraising to supplement other maintenance operational costs through special events and other activities.
7. PPR has agreed to continue to schedule programming and rentals at WCC for the term of the agreement, if it is able to remain cost neutral.
8. The Director of Parks and Recreation recommends the approval of this shared use agreement as a temporary arrangement.
NOW, THEREFORE, the Council directs:
a. The Commissioner in Charge of Portland Parks and Recreation, the Mayor in charge of ONI and the City Auditor are authorized to execute a Shared Use Agreement on behalf of the City of Portland substantially in the form of the Agreement attached to this Ordinance as Exhibit A with the Woodstock Neighborhood Association and the Office of Neighborhood Involvement.
b. ONI funds for operation of WCC shall be deposited into the Parks Trust Fund (Woodstock Building Operating). WNA/FWCC funds for operation of WCC may be deposited into a WNA/Southeast Uplift account or the Parks Trust Fund (Woodstock Building Fund).
Section 2. The City Council declares that an emergency exists due to the lapsed preceding Agreement and the parties’ good faith continuation in the absence of this renewed Agreement, therefore, this Ordinance shall be in force and effect after its passage by Council.
