Authorize contract with Counterpoint Consulting for technical assistance for the Water Pollution Control Facilities and National Pollutant Discharge Elimination System Municipal Separate Storm Sewer System Permits for $95,000 per year up to five years (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The City of Portland holds a National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) permit to improve water quality by reducing the discharge of pollutants to the municipal stormwater system. Permit activities are implemented through the Stormwater Management Plan (SWMP). The permit, reissued in July 2005, includes extensive new program assessment, reporting and evaluation requirements.
2. In June 2005, the City was issued a Water Pollution Control Facilities permit for Class V Stormwater Underground Injection Control (UIC) Systems (WPCF). The WPCF permit regulates the City’s stormwater sumps to protect groundwater resources. The WPCF permit requires development of a Citywide UIC Management Plan and other related plans and compliance documents.
3. Technical assistance is needed to respond to NPDES MS4 and WPCF permit requirements within permit timelines. Assistance is needed with the preparation of required compliance reports, permit related technical assessments and inventories, and other guidance materials, as well as with coordination among NPDES co-permitees, City Bureaus, citizen advisory committees and other stakeholders. To meet this need, a formal Request for Proposals process was conducted in November 2005 by the Bureau of Environmental Services. The evaluation committee selected Counterpoint Consulting as the most qualified firm.
4. The established cost is $95,000 per year for up to five years, for a total not to exceed $475,000. Funds are available in the Sewer System Operating Fund, FY 2005-06 Budget, Bureau of Environmental Services, Center Codes 145-31-043 and 145-31-010, Account No. 521000.
NOW, THEREFORE, the council directs:
a. The Commissioner of Public Utilities and Auditor are authorized to execute a contract with Counterpoint Consulting for the purpose described in Section 1 and as attached as Exhibit A in the amount of $95,000 per year for up to five years, for a total not to exceed $475,000.
b. The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Sewer System Operating Fund Budget when demand is presented and approved by the proper authority.
