ORDINANCE No. 179860
*Authorize an Intergovernmental Agreement with Metro and Oregon Parks and Recreation Department to purchase a Conservation Easement and to provide payment of $200,000 for the TRY/ON Life Community Farm Property (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. The Bureau of Environmental Services has determined that it is beneficial for watershed health and preservation of natural areas to partner with Metro and Oregon Parks and Recreation Department to participate in the funding and management of and share in a Conservation Easement in the TRY/ON Life Community Farm Property in an amount not to exceed $200,000.
2. The TRY/ON Life Community Farm Property Conservation Easement will protect and preserve valuable habitat and open area in the City of Portland and will benefit the people of the City.
NOW, THEREFORE, the Council directs:
a. The Commissioner of Public Utilities is authorized to enter into an intergovernmental agreement in substantially the form of the attached Exhibit A.
b. The Mayor and the City Auditor are hereby authorized to issue a warrant or, alternatively, to wire funds to an escrow account for the TRY/ON Life Community Farm Conservation Easement at Fidelity National Title Company from Bureau of Environmental Services Center Code 145300005, Sustainable Stormwater Program
Section 2. The Council declares that an emergency exists because the opportunity to purchase the Conservation Easement must be exercised by January 5, 2006; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
