ORDINANCE No. 179699

 

Authorize an Intergovernmental Agreement with the Institute for Tribal Government at Portland State University for services associated with Portland Harbor Superfund Site (Ordinance)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The Council has designated the Bureau of Environmental Services as the City’s lead representative in the Portland Harbor Superfund Cleanup.

 

2.  Six Tribal governments play an important role in this project as natural resource trustees and sovereign nations, and have an interest in environmental cleanup and natural resource restoration opportunities associated with the Portland Harbor Superfund Site.

 

3.  The City has a unique role in the Superfund project, as both a potentially responsible party and a government entity charged with the public responsibility of protecting the river and its resources. The City desires to work on a government-to-government basis with Tribal governments

 

4.  The Institute for Tribal Government at Portland State University serves elected tribal governments and works with local, state and federal government agencies on Tribal issues.

 

5.  The intergovernmental agreement will allow the Institute to provide advice, guidance and facilitation support on communicating and coordinating with Tribal Governments involved in Portland Harbor, allowing the City to build upon existing Government-to-Government relationships.

 

6.  The established cost is $20,000. Funds are available in the Environmental Remediation Fund, FY 2005-06 Budget, Bureau of Environmental Services, Center Code [150-50-005], Account No. 529000.

 

NOW, THEREFORE, the council directs:

 

a.  The Director of Environmental Services and the Auditor are authorized to execute an intergovernmental agreement with the Tribal Institute at Portland State University, for the purpose described in Section 1, in a form substantially in accordance with Exhibit A, in the amount of $20,000. The Director is authorized to renew the intergovernmental agreement for up to three years, with an annual cost not to exceed $ 30,000 per year.

 

b.  The Mayor and Auditor are hereby authorized to draw and deliver warrants chargeable to the Environmental Remediation Fund Budget when demand is presented and approved by the proper authority.
