RESOLUTION No. 36365

 

Accept report of City Attorney regarding documents requested from Portland General Electric (Resolution)

 

WHEREAS,    In Resolution No. 36337 (Substitute) passed on September 21, 2005, the Council directed the City Attorney to initiate an information gathering process with PGE pursuant to City Charter Section 10-106;

WHEREAS,    Section 10-106 of the Charter authorizes the Council to investigate from time to time the affairs, business and property of any public utility operating within the City;

WHEREAS,    The Council directed the City Attorney to request specific information regarding the amounts PGE collected from customers within the City of Portland for payment of state, federal and local income taxes, as well as the amount of the claims PGE had against Enron and whether those claims were waived or otherwise released;

WHEREAS,    PGE has provided documents in response to the Council’s request; and

WHEREAS,    The City Attorney has prepared a report summarizing the information obtained from those documents.

 

NOW, THEREFORE, BE IT RESOLVED that the report of the City Attorney regarding the documents requested from PGE is accepted;

 

BE IT FURTHER RESOLVED that the Council will set a hearing to be held in February 2006, to provide an opportunity for PGE and others to respond to the City Attorney’s report.
