RESOLUTION No. 36308  

 

Clarify the City of Portland Percent for Art program (Resolution)

 

WHEREAS, the City of Portland under Portland Code Chapter 5.74 (Acquisition of Art) currently dedicates a percentage of the Total Costs of all Improvement Projects to the selection, acquisition, siting, maintenance, administration, Deaccessioning, community education and registration of Public Art, referred to herein as Percent for Art;

 

WHEREAS, Improvement Project, under Percent for Art “means any project paid for wholly or in part by the Participating Bureau in which the Participating Bureau’s contribution equals $100,000 or more, involving construction, rehabilitation, remodeling or improvement of any building, structure, park, public utility, street, sidewalk or parking facility or any portion thereof within the limits of the City of Portland”;

 

WHEREAS, although certain entities including but not limited to Portland Streetcar, Inc., Portland Aerial Transportation, Inc., and the Housing Authority of Portland are not Participating Bureaus, they may receive funds from Participating Bureaus for Improvements Projects as that term is defined in the Code;

 

WHEREAS, the Council recognizes the great value of public art and its role in enhancing the livability and marketability of Portland;

 

BE IT RESOLVED, the Council interprets Chapter 5.74 of City Code to provide that when entities, including but not limited to Portland Streetcar, Inc., Portland Aerial Transportation, Inc., and the Housing Authority of Portland, receive funds from Participating Bureaus for Improvement Projects, the requirements of the City of Portland’s Percent for Art Code provisions, including future revisions, are applicable to those Improvement Projects.

 

BE IT FURTHER RESOLVED, the Council interprets Chapter 5.74 of City Code to provide that the Regional Arts Cultural Council, as administrator of the Chapter, may provide for periodic audit reviews for compliance by Participating Bureaus and entities receiving funds from Participating Bureaus.
