Declare intent to initiate local improvement district formation proceedings to construct street and stormwater improvements from 26th Avenue to 29th Avenue and on other streets in the SW Texas Green Street Local Improvement District (Resolution; C-10014)
WHEREAS, valid petitions from owners of properties within the proposed SW Texas Green Street Local Improvement District were filed with the Local Improvement District Administrator as contained in Exhibit A (attached to the original only);
WHEREAS, the Local Improvement District Administrator has reviewed the petitions attached in Exhibit A and has determined all of them to be valid; and
WHEREAS, the Bureau of Transportation Engineering & Development is the Responsible Bureau for the proposed improvement and recommends initiation of a local improvement district; and
WHEREAS, the petitions contain signatures of owners of property representing a majority of the property which will be specially benefited by the proposed improvement as evaluated in Exhibit B; and
WHEREAS, the Hillsdale Neighborhood Association, Multnomah Neighborhood Association and Southwest Transportation Committee were notified of this project on January 7, 2005 and notice of this project was submitted for publication on the Portland Online web site on January 4, 2005;
NOW, THEREFORE, BE IT RESOLVED, that the general character and scope of the improvement is to remove the existing dirt, gravel and/or hard surface; grade streets to their proper subgrade; construct asphaltic concrete streets with an aggregate base, curbs and sidewalk; and construct an integrated stormwater system consisting of swales, conduits, stormwater sewer pipes and stormwater management facilities as shown in Exhibit C; unless this project scope is modified by City Council at the Local Improvement District Formation Hearing; and
BE IT FURTHER RESOLVED, that the City Council declares the intent of the City to initiate local improvement district formation proceedings to construct street and stormwater improvements on SW Texas Street from 26th Avenue to the west line of 29th Avenue; on SW 26th Avenue from 110 feet north of the north line of SW Texas Street to 160 feet south of the south line of SW Texas Street; on SW 28th Avenue from the south line of SW California Street to the north line of SW Nevada Court; on SW 29th Avenue from the north line of SW Nevada Court to SW Texas Street as shown in Exhibit D plus any transition work on abutting intersection(s) determined to be necessary by the City Engineer; and
BE IT FURTHER RESOLVED, that the local improvement district shall be known as the SW Texas Green Street Local Improvement District and for purposes of the Local Improvement District Formation Hearing as set forth in Section 17.08.070 of City Code, the boundary shall be as shown in the map in Exhibit D; and
BE IT FURTHER RESOLVED, that the preliminary estimate of the cost of the improvement is $2,057,703; and
BE IT FURTHER RESOLVED, that the assessment methodology of the local improvement district shall be on a square footage basis unless this assessment methodology is modified by City Council at the Local Improvement District Formation Hearing. Properties abutting street(s) to be improved that also abut other street(s) with previous frontage improvements to current City standards will receive a 25% reduction in the calculation of assessable area. Properties abutting SW 26th Avenue or SW 27th Avenue that do not abut street(s) to be improved will receive a 50% reduction in the calculation of assessable area; these properties benefit from improved access via SW Texas St. Properties abutting SW California Street that do not abut street(s) to be improved will receive a 75% reduction in the calculation of assessable area; these properties benefit from improved access via SW 28th Avenue and SW Texas St.; and
BE IT FURTHER RESOLVED, that for purposes of notification for the LID Formation Hearing, the property with State ID #1S1E20AA 2201 (Tax Account #R887800650) shall receive a 75% reduction in the calculation of assessable area instead of a 50% reduction in the calculation of assessable area as petitioned, due to its access being via SW California Street in lieu of SW Texas Street, with the resulting reduction in the property owners’ share of the project being deducted from the contingency portion of the budget; and
BE IT FURTHER RESOLVED, that based on the project as petitioned, property owners will provide funding estimated at $923,364 plus the costs of any extra work on private property; the Bureau of Environmental Services will absorb all stormwater costs estimated at $711,000 plus project management costs estimated at $23,200; and the Portland Office of Transportation will absorb previously-incurred costs of $179,796 in addition to overhead costs estimated at $220,343; and
BE IT FURTHER RESOLVED, that the project will be constructed through the competitive bid process; and
BE IT FURTHER RESOLVED, that the City Council intends to construct the improvement upon formation of the local improvement district; and
BE IT FURTHER RESOLVED, that the City Council directs the Local Improvement District Administrator to initiate local improvement district formation proceedings as set forth in Section 17.08.070 of City Code and to schedule a Local Improvement District Formation Hearing on March 30, 2005 at 9:30 AM or on the earliest practicable date thereafter.
