ORDINANCE No. 179055

*Amend contract with Williams Zografos & Peck for outside counsel assistance (Ordinance; amend Contract No. 34973)

The City of Portland ordains:

Section 1.  The Council finds:

1.  Outside legal counsel is required to assist the City Attorney’s Office in the matter pertaining to the investigation of claims and the Bureau of Maintenance.

2.  The firm of Williams Zografos & Peck entered into Legal Service Agreement No. 34973 to provide these services.

3.  To continue work on this matter, it is necessary to increase the amount of this agreement by an additional $15,000 bringing the total amount to $35,000.

4.  Due to the work needed to be accomplished in this matter, the effective dates of this agreement need to be extended to January 4, 2006.

NOW, THEREFORE, the Council directs:

a.  The City Attorney is authorized to increase Legal Services Agreement No. 34973 to provide for such legal services in the amount not to exceed $35,000.

b.  The effective date of this agreement is extended to January 4, 2006.

c.  If applicable, the provisions of City Code Chapter 5.68 are waived.

d.  The Auditor is authorized to draw and deliver checks in payment of legal services provided under this Legal Services Agreement.

Section 2.  The Council declares that an emergency exists in order to pay for legal services necessary in the matter of the Bureau of Maintenance investigation; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
