* Authorize agreement with Union Pacific Railroad for reimbursement of costs to relocate

sewers and appurtenances (Ordinance)  

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  Union Pacific Railroad (UPRR) is in the process of realigning the main switchyard tracks

to the Albina Yard at N. Railroad St. and Larrabee Ave., and this realignment of the

tracks will impact the integrity and the operation and maintenance of the city’s sanitary

sewer system at the following locations:

 

a.  The N Railroad St. track realignment will impact at least three sanitary manholes and 380 lineal feet of sanitary sewer line placing them under the tracks. The proposed sanitary sewer realignment will allow the abandonment of sewer line within limits of UPRR tracks. BES proposes to relocate the sewer line across the track to the paved right-of way area west of the tracks beginning approximately 130+/- ft south of Harding St. The realignment under the tracks will be accomplished by using boring, jacking or directional drilling method (approximately 65 ft). The realignment of the sewer in the paved right-of way will be accomplished using conventional construction method.

 

b.  The N Larrabee Ave track realignment will impact one sanitary sewer manhole. BES proposes to realign by boring or jacking 135 lineal feet of sewer pipe which will relocate the impacted sanitary manhole out of UPRR track alignment

2.  UPRR will reimburse the city the full costs, up to $300,000 for the relocation of the

subject facilities

 

3. The City will bill UPRR for the cost of the sewer realignment as those costs are incurred. Billing will

occur as stipulated in the attached Agreement until the realignment is complete or until $300,000 has

been billed.

 

NOW, THEREFORE, the council directs:

 

a.  The Commissioner in charge and Auditor are authorized to execute the attached

agreement with Union Pacific Railroad for the purpose described in Section 1.

 

Section 2. The Council declares that an emergency exists because Union Pacific Railroad is, at this time,

constructing the track realignment and will require the immediate relocation of BES facilities.

Delay in proceeding with the authorization will jeopardize the completion of UPRR’s project and

impacting the routing of rail service. Therefore, this ordinance shall be in full force and effect from

and after its passage by the Council.
