ORDINANCE No. 179033

 

*Authorize the Director of the Bureau of Environmental Services to enter into a Intergovernmental Agreement with Metro to transfer $200,000 for the design and construction of stormwater management facilities constructed as retrofits to existing development on the Oregon Zoo and Washington Park Parking Lot properties (Ordinance)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The Bureau of Environmental Services (BES) mission is to improve and protect water quality in Portland’s streams and waterways. Currently, combined sewer overflows (CSOs) and direct stormwater discharges impair water quality in the Willamette River and other Portland streams. Additional adverse impacts from stormwater and sewage discharges include stream channel erosion, increased flooding, and fish habitat destruction.

 

2.  The Clean River Plan, an integral part of River Renaissance, outlines actions for improving watershed health, including the reduction of combined sewer overflows and direct stormwater discharges to Portland’s streams and rivers. The plan calls for a variety of stormwater controls that can help the City meet its regulatory mandates for protecting water quality.

 

3.  To protect water quality, BES is controlling CSOs and managing stormwater by using approaches such as downspout disconnections, vegetated infiltration facilities, impervious area removal, and stormwater planter boxes. These approaches retain stormwater on site, which helps to reduce CSOs and also filter stormwater before it reaches Portland’s streams, which reduces pollution in stormwater runoff.

 

4.  In May of 2003, BES received a distribution of money from the Environmental Protection Agency to implement innovative wet weather controls throughout the City of Portland. Projects include implementation of green street and green parking lot stormwater designs, disconnection of downspouts on commercial, industrial and institutional sites; and implementation of other innovative stormwater control projects such as ecoroofs.

 

5.  Portland Metropolitan Service District, (Metro), manages the Oregon Zoo which includes over 64 acres of land, including buildings, parking lots and animal areas that contribute to stormwater runoff. Metro is an active partner in efforts to reduce stormwater runoff related pollution.

 

6.  The intergovernmental agreement (IGA) attached as Exhibit A defines terms and responsibilities for BES and Metro to transfer $200,000 for the design and construction of stormwater management facilities constructed as retrofits to existing development on the Oregon Zoo and Washington Park Parking Lot properties. Facilities are described more fully in the pre-design details of Exhibit B.

NOW, THEREFORE, the council directs:

 

a.  The Director of the Bureau of Environmental Services is authorized to execute an intergovernmental agreement with the Portland Metropolitan Service District, as outlined in Exhibit A for the purpose described in Section 1 as approved by the Commissioner-in-Charge.

 

b.  The Director of the Bureau of Environmental Services is authorized to amend this agreement as approved by the Commissioner-in-Charge.

 

c.  The Council declares that an emergency exists because on the limited timeframe for implementing the monies provided by the EPA Innovative Wet Weather Grant. Therefore, this ordinance shall be in full force and effect from and after its passage by the Council.

 

d.  The Mayor and the Auditor herby are authorized to draw and deliver funds chargeable to the FY 2004-2005 Sewerage System Budget, Center Code 14532130, Project No.7752 for support of these projects with funds that will be reimbursed by the EPA Innovative Wet Weather Grant monies.

 

 

Section 2. The Council declares that an emergency exists because of the need to contract and build prior to the June 30, 2005 deadline to use the grant money; therefore, this ordinance shall be in full force and effect from and after its passage by Council.
