ORDINANCE No. 179019

*Authorize an Intergovernmental Agreement with the Oregon Department of Transportation for $60,000 to perform an Environmental Assessment on I-5 between Delta Park and Lombard. (Ordinance)

The City of Portland ordains:        

Section 1.  The Council finds:

1.  The Portland-Vancouver I-5 Transportation and Trade Task Force’s I-5 Strategic Plan, The Regional Transportation Plan and the State Transportation Improvement Program call for a project on I-5 between Delta Park and Lombard to widen the freeway to three lanes in the southbound direction.  

2.  The Oregon Department of Transportation and the City are conducting an Environmental Assessment for the I-5: Delta Park to Lombard Project.

3.  The Oregon Department of Transportation and the City have agreed that the City of Portland should participate as an active partner in the development of the I-5: Delta Park to Lombard project through the entire Environmental Assessment phase.

4.  The Oregon Department of Transportation and the City have agreed that the City of Portland, as an active partner in the project, shall be a member of the Project Steering Committee with the Oregon Department of Transportation and the Federal Highway Administration in providing overall project management of the environmental Assessment.

NOW THEREFORE, the Council directs:

a.  The Commissioner of Public Utilities and the Auditor are authorized to enter into an Intergovernmental Agreement with the Oregon Department of Transportation in a form substantially similar to that attached (Exhibit A) to the original of this Ordinance and by this reference, made a part thereof.  

Section 2.  The Council declares that an emergency exists so that the Intergovernmental agreement herein authorized may be entered into and the I-5: Delta Park to Lombard Environmental Assessment may commence without undue delay; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
