AMENDMENT NO. 2

This amendment is entered into by the CITY OF PORTLAND, a municipal corporation of the State of Oregon (City), and EMMONS ARCHITECTS (Consultant).

RECITALS:

1.  On July 17, 2002 the City entered into Contract No. 34320 in the amount of $156,328 for Emmons Architects to provide architectural and engineering services for the design and construction of Fire Station 27.

 2.  On March 24, 2004 Contract Amendment No. 1 was approved in the amount of $47,952 for additional services relating to applying for a Conditional Use permit to Multnomah County, and extended the date of termination of the contract two years.

3.  Additional services required for the design and construction of Fire Station 27 are described in the attached letter dated December 6, 2004 (Exhibit A).

4.  The fee for the additional services listed in paragraph 3 above is $23,058.

5.  The termination date is July 1, 2006 and will be unchanged in this Contract Amendment.

6.  The City of Portland and the Consultant wish to increase the Contract amount by $23,058 for a total contract amount of $227,338 to allow for completion of architectural and engineering services for the design and construction of Fire Station 27.

IN CONSIDERATION OF THE MUTUAL PROMISES OF THE PARTIES IT IS AGREED:

1.  Contract No. 34320, dated July 17, 2002 is hereby amended to provide additional architectural and engineering services as described in paragraph 3 above in the amount of $23,058 for a total contract amount of $227,338.

2.  All other terms and conditions shall remain the same.
