ORDINANCE NO. 179012

 

*Amend contract with Winterbrook Planning for continuation of planning services for Fire Station 27 (Ordinance; amend Contract No. 33814)

 

The City of Portland ordains:

 

Section 1.  The Council finds:

 

1.  The City entered into Contract No. 33814 in the amount of $19,760.00 on August 24, 2001 for Winterbrook Planning to provide planning services for design and construction of Fire Station 27.

 

2.  Amendment No. 1, dated August 8, 2002 extended the contract three (3) months to October 15, 2002 to provide for continuation of planning services.

 

3.  Amendment No. 2, dated October 21, 2002 extended the contract eight and one-half (8 ½) months to July 1, 2004 to provide for continuation of planning services.

4.  Amendment No. 3, dated November 15, 2002 increased the contract amount $18,430.91 to complete a revised and expanded work scope.

 

5.  Amendment No. 4, dated September 5, 2003 increased the contract amount $16,000.00 to provide for additional planning services. The additional services included researching and responding to issues raised by Hearings Officer and public.

 

6.  Ordinance No. 177798, passed by Council August 27, 2003 authorized the Bureau Director to amend Contract No. 33814 up to an additional $11,000.00 for additional planning services for design and construction of Fire Station No. 27.

 

7.  Amendment No. 5, dated March 29, 2004 increased the contract amount $11,000.00 for a new total contract amount of $65,190.91 to provide for additional planning services for a second application and public hearing for the Conditional Use permit.

 

8.  Amendment No. 6, dated July 15, 2004 extended the contract an additional five (5) months to December 31, 2004 to allow for completion of planning services for the design and construction of Fire Station 27. It was determined that a third Conditional Use Application was required to be submitted to Multnomah County as a result of several unacceptable conditions from the second public hearing, and an increase in construction material costs requiring changing the design of the exterior of the building to reduce costs to stay within the project budget.

 

9.  Additional services required for continuation of planning services for Fire Station 27 are described in the attached Contract Amendment No. 7 (Attachment A).

 

 

10.  The fee for the additional services listed in paragraph 9 above is $29,000.00.

 

11.  The Bureau of General Services recommends that Contract No. 33814 with Winterbrook Planning be amended to increase the contract by $29,000.00 to provide additional planning services for the design and construction of Fire Station 27 for a total contract amount of $94,190.91.

 

 

NOW, THEREFORE, the Council directs:

 

a.  The Mayor and Auditor are authorized to amend Contract No. 33814 to increase the contract amount by $29,000.00 for a total contract amount of $94,190.91 for additional planning services for the design and construction of Fire Station 27 as described in paragraph 9 above.

 

b.  The Mayor and Auditor are hereby authorized to draw and deliver checks chargeable to the fiscal year 2004-05 budget of Facilities Services when demand is presented and approved by the proper authorities.

 

Section 2.  The Council declares that an emergency exists because a delay in proceeding with this amendment could result in additional expense to the City; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
