ORDINANCE No. 179007

*Amend contract with Portland Streetcar, Inc. to provide construction management and other professional and technical services related to the Portland Streetcar Gibbs Extension Project and preliminary analysis for an extension of streetcar service from SW Gibbs to SW Bancroft (Ordinance; amend Contract No. 31428)

The City of Portland ordains:

Section 1.  The Council finds:

1.  On August 4, 2004, the City Council passed Ordinance No.178654 authorizing an amendment to the Portland Streetcar, Inc. (PSI) Agreement No. 31428 for PSI and its consultants to complete preliminary and final engineering services for the Portland Streetcar Gibbs Extension Project (Project).

2.  Preliminary and final engineering services on the Project have been successfully completed by PSI.

3.  On December 8, 2004, Council passed Ordinance No. 178948, as amended, creating the Portland Streetcar Gibbs Extension Project Local Improvement District and Ordinance No. 178949 amending Agreement No. 51529 with TriMet for financial support of the operations of the Project.

4.  On December 15, 2004, Council is expected to adopt the final capital plan for the Project, an amendment to the Inekon Contract for the purchase of three (3) additional streetcar vehicles and an amendment to the Stacy and Witbeck, Inc. Contract for construction of the Project.

5.  The City would like PSI to provide management and design services during the construction of the Project; to carry our preliminary and final engineering design of the Streetcar Maintenance Facility modifications and expansion required with the purchase and delivery of additional streetcar vehicles; and to provide management, inspection and administrative services associated with the purchase of the additional streetcar vehicles.

6.  The City also would like PSI to undertake a preliminary analysis related to the future extension of streetcar service from SW Gibbs to SW Bancroft (Portland Streetcar Phase 3c Project) and to coordinated that work with ongoing South Waterfront development and utility and street construction work in order to minimize future disruption and cost.

NOW, THEREFORE, the Council directs:

a.  The Commissioner of Public Utilities and the Auditor are hereby authorized to execute an amendment to Agreement No. 31428 substantially in accordance with the amendment attached to the original of this Ordinance and, by reference, made a part hereof.

b.  The Mayor and Auditor are hereby authorized to draw and deliver checks to Portland Streetcar, Inc., chargeable to the Transportation Operating Fund, AU 159.

Section 2. The Council declares that an emergency exists because of the importance of beginning construction and purchasing additional streetcars to the integrity of the final capital plan; therefore, this Ordinance shall be in full force and effect from and after its passage by Council.
