ORDINANCE No. 178989
* Amend Human Resources Administrative Rule 8.04 Compensation (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1. Human Resources Administrative Rule 8.04 (Exhibit A) allows a Commissioner, for their staff, and the City Attorney, for her non-represented employees, to designate or change the employee’s salary, within the pay range, at any time.
2. For all other non-represented employees their rate of pay within the range can only be adjusted at initial appointment or anniversary date except when the adjustment is requested for the following reasons and approved by the Director of Human Resources:
• Due to a bonafide retention issue for a key position; or
• Due to a substantial increase and expansion of the job responsibilities within the classification of the employee; or
• To increase the compensation of existing employees, when due to market considerations a new employee within the same classification and work group is initially appointed to a higher level within the range; or
• The scope of work expected of an employee in a newly created position is broader than originally anticipated at the time the position was created.
3. Each Council Member should have the same flexibility to adjust a Bureau Director’s salary, within the pay range, as they do for their own staff, providing such adjustment is upwards only and is based on merit as documented in a performance review.
NOW, THEREFORE, the Council directs:
a. Human Resources Administrative Rule 8.04 is hereby amended by adding a new section as follows:
Compensation for Bureau Directors: The salary of any bureau director may be adjusted at any time provided the pay adjustment is within the pay range, is upward only, and is in recognition of exemplary performance as documented in a performance review submitted to the Bureau of Human Resources.
Section 2. The Council declares that an emergency exists because of the importance of providing this flexibility and recognition to Council Members and bureau directors in a timely fashion; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.
