ORDINANCE No. 178883

 

 

*Amend Intergovernmental Agreements with Oregon Department of Transportation to provide additional funding on SE Hawthorne Boulevard transportation improvements project between SE 20th and SE 55th (Ordinance; amend Contract Nos. 51754 and 50635)

 

The City of Portland ordains:        

 

Section 1.  The Council finds:

 

1.  The City Council authorized an Intergovernmental Agreement with the Oregon Department of Transportation (ODOT) to provide $1,500,000 of federal Congestion Mitigation and Air Quality (CMAQ) funds to undertake transportation improvements on SE Hawthorne Boulevard between SE 20th Avenue and SE 55th Avenue on March 13, 2002 (Contract No. 51754 and Ordinance No. 176308).

 

2.  The City Council authorized an Intergovernmental Agreement with ODOT to undertake Phases III and IV of the Pedestrian Facilities to Transit Access Project on January 3, 1996 (Contract No. 50635 and Ordinance No. 169680).

 

3.  The City Council authorized an Intergovernmental Agreement with ODOT to undertake the Woodstock Boulevard Pedestrian Improvements Project on March 5, 1997 (Contract No. 50876 and Ordinance No. 170965).

 

4.  The City Council authorized amending the agreement for the Pedestrian Facilities to Transit Access Project to reduce the project funds by $280,000 and authorized amending the agreement for the Woodstock Boulevard Pedestrian Improvements Project to approve the transfer of $280,000 to the project on September 22, 1999 (Ordinance Nos. 173780 and 173781).

 

5.  During project closeout, it was determined that unused construction funds from the Pedestrian Facilities to Transit Access Project and from the Woodstock Boulevard Pedestrian Improvements Project totaled $107,405.

 

6.  The Metro Council and the Oregon Transportation Commission approved a request to transfer $107,405 to the Hawthorne Boulevard transportation improvements project to increase the project’s total federal CMAQ funds to $1,607,405.

 

7.  Sufficient funds are available in the Hawthorne Boulevard transportation improvements project’s budget to cover the City’s local match requirements for the increased funds.

 

NOW, THEREFORE, the Council directs:

 

a.  The Mayor and the Auditor are hereby authorized to execute an amendment to Contract No. 50635 with the Oregon Department of Transportation to limit the Pedestrian Facilities to Transit Access Project funds to $645,688, in substantially the form set forth in Exhibit A, attached to this Ordinance.

 

b.  The Mayor and the Auditor are hereby authorized to execute an amendment to Contract No. 51754 with the Oregon Department of Transportation to increase the Hawthorne Boulevard transportation improvements project funds to $1,607,405, in substantially the form set forth in Exhibit B, attached to this Ordinance.

 

Section 2. The Council declares that an emergency exists because delay in executing these amendments will delay construction of these improvements; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
