ORDINANCE No. 176391

 

*Amend agreement with R&W Engineering, Inc. for additional time to complete design engineering and construction engineering services (Ordinance; amend Contract No. 32460)

 

The City of Portland ordains:

 

Section 1. The Council finds:

 

1. On June 23, 1999, the City Council passed Ordinance No. 173489 authorizing flexible services contracts with 14 consulting firms to assist the Portland Office of Transportation (PDOT) with the implementation of capital improvement projects.

 

2.  The City of Portland entered into Agreement No. 32460 with R&W Engineering, Inc. (R&W) on July 29, 1999, for technical support of street lighting activities for a 2-year period, with an option to renew for 1 additional year. The total value of the contract was not to exceed $150,000 annually.

 

3.  On July 11, 2001, PDOT executed Contract Amendment No. 1 providing for an extension of the contract to June 30, 2002.

 

4.  PDOT has issued a total of 5 contract work orders to R&W totaling $73,370.48 under the terms of Agreement No. 32460. Four of the work orders have been completed, but one is continuing, that being for the NE Clark/ 105th/Holman Project.

 

5.  R&W requires additional time to finalize design and provide construction services as defined in Work Order No. 5 for the NE Clark/105th/Holman Project. Construction is anticipated to be complete December 31, 2003.

 

6.  PDOT recommends extending the terms of Agreement No. 32460 to December 31, 2003, to allow adequate time for completion of engineering services.

 

7.  All other terms and conditions remain the same.

 

NOW, THEREFORE, the Council directs:

 

a.  The Commissioner of Public Safety and the Auditor are authorized to execute an amendment to Agreement No. 32460 between the City of Portland R&W Engineering, Inc., substantially in accordance with the Amendment attached as Exhibit A to the original of this Ordinance, and by reference made a part hereof.

 

Section 2. The Council declares an emergency exists because a delay in processing this amendment may delay design completion and construction of the NE Clark/105th/Holman project which could result in additional expense to the City; therefore, this Ordinance shall be in full force and effect from and after its passage by Council.
